Tory MP Suella Braverman has published a new paper claiming that leaving the Strasbourg court will secure borders and end the small boats crisis, while defending national security and restoring effective policing. It pays particular attention to Northern Ireland, which incomplete Brexit arrangements mean is governed under different legal norms, stemming from the Windsor Framework and Belfast Agreement,
The report, Why and How to Leave the European Convention on Human Rights, can be downloaded here. Published by the centrist Prosperity Institute think tank, its coauthor Guy Dampier set out a core proposition:
The United Kingdom cannot claim to be truly united with one of its four nations subject to laws created by a foreign court over which we have no democratic control. This report outlines a realistic, technical, and feasible route out of the ECHR, which will allow for the removal of the Irish sea border and restore the sovereignty of the United Kingdom.
Backed by Richard Tice of Reform UK, among others, Braverman and Dampier’s arguments coincide with the growing concern that the ECHR is being used to thwart effective border controls in Britain, not least ‘small boat crossings’ paid for by individuals who then attempt to claim asylum.
