A detainee’s use of German gender ID laws—most likely a political prank—has complicated the cross-border transfer of a prisoner.

‘Marla-Svenja Liebich’ will be extradited to Germany by the Czech Republic, according to a local court on Monday, June 1st.

Formerly known as Sven Liebich, the provocateur failed to report to a German prison in August 2025 and fled the country. This followed an 18-month prison sentence in 2023 for offences including incitement to hatred, insult, trespass, and defamation (viewed by his supporters as speech crimes).

Liebich used Germany’s updated November 2024 gender recognition laws, which include elements of ‘self-ID,’ to argue that he was now female and should serve his time in women’s prisons. Subsequently Federal Minister of the Interior Alexander Dobrindt cited the case as proof that the law could be abused. Even if Reuters keeps referring to him as ‘she,’ it appears that Liebich is the ‘wrong’ type of ‘transwoman’ to be recognised as such by the political establishment in the Federal Republic.

In Plzeň on May 18th, Liebich—who still retains the right to appeal—told an initial hearing that extradition would lead to unsafe confinement in the male prison estate. Nevertheless, Czechia looks set to return the provocateur to Germany.
